News Alert: Key amendments to the Spanish Gambling Act on the way.

The Official Gazette of the Spanish Parliament (Boletín Oficial de las Cortes Generales) has published the Opinion of the Social Rights and Consumer Affairs Committee on the Draft Law regulating customer service. This text incorporates significant amendments to Law 13/2011, of May 27, on the regulation of gambling.

The primary objective of these reforms is to provide a statutory basis for the articles of Royal Decree 958/2020, of November 3, on commercial communications for gambling activities, which were annulled by the Supreme Court in its ruling of April 2024. This legislative action addresses the Court’s finding that such matters were subject to the principle of reservation of law (reserva de ley), thus requiring regulation by a formal Act of Parliament. The reform also serves to elevate existing regulatory obligations to statutory rank, lay the foundations for future regulatory developments, and introduce new, significant obligations for B2B suppliers.
