Loyra has contributed to the 2026/27 edition of the International Gambling Laws & Regulations Review, published by Beaumont Capital Markets in collaboration with the International Association of Gaming Regulators (IAGR).
The Spain chapter, authored by partners Patricia Lalanda and Cristina Romero de Alba, examines the framework governing gambling advertising at a particularly sensitive moment: the run-up to the FIFA World Cup.
The tournament brings a significant commercial opportunity for operators and, at the same time, a growing level of regulatory scrutiny. The chapter addresses the issues set to shape the sector in the months ahead:
- The dual regulatory framework. The interplay between national rules —with Royal Decree 958/2020 at their core— and those of Spain’s seventeen Autonomous Communities, which produces a fragmented map, particularly for physical advertising in stadiums, hotels and live events.
- The Supreme Court’s intervention. Ruling 527/2024 annulled several of the most restrictive articles of RD 958/2020 and established that any restriction on the freedom of enterprise must be necessary and proportional.
- The digital frontier. User-Generated Content (UGC), influencers and affiliates, over which the DGOJ has intensified its direct oversight.
- Regulatory developments on the horizon. The single risk-detection algorithm and the joint cross-operator deposit limit.
The analysis makes clear that, in this environment, success will be determined not by the scale of marketing budgets, but by the sophistication of each operator’s legal and compliance strategy.
